This Privacy Policy describes how Korean Red Ginseng Corp, Inc. (“KGC,” “we,” “us,” or “our”) and, where applicable, our affiliates collect, use, and disclose Personal Information when you use jungkwanjang.us, purchase our products, enroll in our Rewards Program, use subscription features, use product-matching or recommendation tools, submit reviews or other content, or otherwise interact with us (collectively, the “Services”).

This Privacy Policy is intended for our U.S. operated consumer ecommerce Services unless a separate notice applies. This Privacy Policy also applies to business contacts, franchise inquiries, wholesale or retail-partner inquiries, dealer or distributor contacts, and job applicants where we collect Personal Information through the Services or in connection with our business operations, unless a separate notice is provided.

Throughout this Privacy Policy, “Personal Information” means information that identifies, relates to, or can reasonably be linked with an individual or household. The term “Personal Information” includes “personal data” and similar terms under applicable U.S. state privacy laws. It does not include information that is publicly available, deidentified, or aggregated, as those terms are defined under applicable law.

Information We Collect

We collect Personal Information directly from you, automatically when you use the Services, and from third parties, as described below.

Information You Provide Directly

Account and Order Information. When you create an account or place an order, we collect your name, email address, postal address, telephone number, account credentials, order details, and payment-related information. Our payment processor handles your full card number and security code; we retain only a tokenized reference, transaction information, and limited payment details such as the last four digits where needed for customer service, accounting, fraud prevention, chargebacks, and refunds.

Rewards Program and Subscription Information. If you enroll in our Rewards Program or use subscription features, including any Subscribe & Save or subscription-management portal, we collect your enrollment details, purchase and redemption history, points balance, program tier or status where applicable, subscription cadence, saved-payment token or reference where applicable, subscription portal login or magic-link information, and communication preferences.

Quiz, Product-Matching, and Preference Information. If you use tools such as our “Find My Match” quiz or other product-recommendation features, we collect the answers and information you choose to provide, such as wellness goals, product interests, dietary or lifestyle preferences, and other information used to suggest products. These tools are informational and are not medical advice. Do not provide medical information or information about a child unless you have authority to do so and all required consents.

Event and survey participation. If you attend an event we sponsor or respond to a survey, we collect the contact information, survey responses, and demographic information you voluntarily provide.

Business contacts. If you contact us as a representative of a business partner, vendor, franchise prospect, wholesale or retail partner, dealer, distributor, or other business contact, we collect your name, title, contact information, and other information you provide in connection with the business relationship.

Communications. When you contact us, we collect your contact details and the content of your message, along with our reply. For returns, refunds, product-quality issues, damaged or incorrect items, or other customer-service matters, we may also collect your order number, photographs, product information, and other information you choose to provide or that we reasonably request to evaluate the issue.

User content. If you submit a review, comment, photo, rating, question, suggestion, testimonial, or other content, we collect it and any associated account or device information. Do not submit content that includes Personal Information about another person, including a child, unless you have authority to do so and all required consents.

Information We Collect Automatically

When you use the Services, we and our service providers automatically collect information about your device and your activity, including your IP address, device type and identifiers, operating system, browser settings, the pages you view, the links you click, the dates and times of those actions, and diagnostic and performance data. We collect this information through cookies, pixel tags, server logs, and similar technologies.

Information We Receive from Third Parties

We also receive Personal Information about you from our affiliates, our service providers and authorized retailers, where applicable (including payment processors, fulfillment partners, customer-service platforms, and analytics and advertising vendors), social-media platforms when you interact with our pages or use any social-media features we make available, publicly available sources, and people who refer you to us.

We and our service providers use cookies and similar technologies (collectively, “cookies”) on our websites and Services. Where required by law, we obtain your consent before using non-essential cookies. You may manage your cookie preferences through any cookie-preferences tool we make available or through your browser settings.

We use four kinds of cookies. Strictly necessary cookies authenticate you, maintain your cart, and prevent fraud; these cannot be turned off. Analytics cookies help us understand and improve how the Services are used. Functional cookies remember your preferences and personalize features. Advertising cookies deliver and measure relevant ads on the Services and elsewhere; you can review targeted-advertising choices below.

How We Use Personal Information

We use Personal Information to provide the Services, including to open and maintain your account, fulfill orders, manage subscriptions and rewards, process returns and refunds, respond to your inquiries, and provide product-matching tools and product recommendations; to personalize content and product suggestions; to send marketing by email or postal mail and, with your consent where required by law, by text message; to deliver and measure ads on the Services and on third-party sites and apps; to analyze and improve the Services; to monitor product quality, respond to complaints, conduct recalls, and report adverse events where required by law; to detect and prevent fraud and abuse, secure the Services, comply with law, and defend legal claims; and to administer accounting, audits, insurance, and corporate transactions.

How We Share Personal Information

We disclose Personal Information to our service providers and contractors (including payment, fulfillment, customer-service, hosting, fraud-prevention, operational, analytics, and marketing vendors), who use it only to perform services for us; to our affiliates where applicable; to advertising partners, social-media platforms, and analytics providers for targeted advertising and cross-context behavioral advertising (these disclosures may be a “sale” or “sharing” under California and similar state laws); to authorized dealers and distributors as needed for order fulfillment, customer service, business operations, and product-quality matters; to our professional advisors, such as accountants, auditors, insurers, and outside counsel; to government and law-enforcement authorities where required by law or to protect rights, property, or safety; to parties involved in a corporate transaction such as a merger, financing, or sale of all or part of our business; and to others with your consent or at your direction.

KGC does not sell Personal Information for monetary consideration. Disclosures to advertising partners and social-media platforms for targeted advertising may be a “sale” or “sharing” under California and similar state laws. You may opt out of sale or sharing as described in this Privacy Policy.

Targeted Ads and Cross-Context Behavioral Advertising

We and our advertising partners use cookies to deliver advertising tailored to your interests, including based on your activity across other sites and apps. To do this, we share identifiers, network activity, commercial information, and inferences with advertising partners and social-media platforms. Under California and similar state laws, these disclosures may be a “sale” or “sharing.”

You may opt out by clicking the “Do Not Sell or Share My Personal Information” link in our website footer, or by enabling the Global Privacy Control (GPC) in your browser, which we honor where required by law.

Our Services do not respond to “Do Not Track” signals. Opt-out tools are specific to the browser, device, or account, so you may need to repeat your choices on each one. Your opt-out applies only to that browser or device unless we can link the request to your account.

Your Privacy Choices

You may opt out of marketing emails by clicking the “unsubscribe” link in any marketing email or by emailing support@kgcus.com; opt out of marketing text messages by replying STOP to any text message or by using any other reasonable method that clearly communicates your request to stop receiving covered messages (standard message and data rates may apply); manage cookies through any cookie-preferences tool we make available or your browser settings; and update your account information by signing in to your account at jungkwanjang.us.

Even if you opt out of marketing, we will continue to send you transactional and administrative messages about your orders, subscriptions, account, and the Services.

Sensitive Personal Information

KGC limits its collection and use of “Sensitive Personal Information,” as defined under California law, to what is reasonably necessary to provide the Services. Depending on your interactions with us, the categories involved may include account log-in credentials for your online account; payment-card information processed by our payment processor for transactions, refunds, fraud prevention, and payment security.

We do not use Sensitive Personal Information for any purpose other than to provide the goods and services you request, to maintain account and transaction security, to detect and prevent fraud, and for other purposes permitted by law without offering an additional right to limit.

Children’s Privacy

Our Services are not directed to children under 13, and we do not knowingly collect Personal Information from them. Certain products may be marketed or labeled for use by children, but the Services, accounts, purchases, subscriptions, reviews, quizzes, and other online interactions are intended for parents and legal guardians, not for children under 13. Minors under 18 may not create an Account or place an Order on their own; a parent or legal guardian must do so on their behalf. If we learn that we have collected Personal Information from a child under 13 without verifiable parental consent, we will delete it. We do not knowingly sell, share, or use for targeted advertising the Personal Information of any minor where applicable law requires opt-in consent. If you believe a child has provided Personal Information to us, please contact us at support@kgcus.com.

Notice of Financial Incentive; Rewards Program

KGC offers a rewards program (the “Rewards Program”) that lets you earn points, discounts, and other benefits. Because we collect Personal Information to administer it, the Rewards Program may be considered a “financial incentive” under California law.

Participation in the Rewards Program is voluntary and is governed by the Rewards Program terms posted on our website, if available, or otherwise disclosed when you enroll. Through the Rewards Program we collect identifiers, purchase and redemption history, points balance, program tier, online activity related to the program, and inferences drawn from those, and we may share this information with service providers that operate the program, our affiliates, and (for targeted advertising and cross-context behavioral advertising) advertising and analytics partners. We estimate the value of Personal Information collected through the Rewards Program based on the expense of offering the program, the value of rewards and discounts provided, and the revenue and customer engagement reasonably attributable to program participation. We believe the value of the Personal Information is reasonably related to the value of the rewards, discounts, and other benefits offered. You may enroll through your account at jungkwanjang.us; to withdraw, follow the instructions in the applicable Rewards Program terms, adjust your account settings if available, close your account, or email support@kgcus.com. After withdrawal, your unredeemed points will no longer be available, but you may continue to shop at jungkwanjang.us on the same terms as any other customer.

We do not pre-enroll you.

California Privacy Rights

This notice applies to California residents and supplements the rest of this Privacy Policy.

Notice at Collection. In the past 12 months, we have collected the categories of Personal Information described in the table below. Categories track the definitions in California Civil Code §§ 1798.140 and 1798.80(e):

We collect Sensitive Personal Information only for the purposes described above. We do not use it to infer characteristics about California residents.

Sources of Personal Information. We collect Personal Information directly from you when you interact with the Services; automatically from your device through cookies and similar technologies; and from our affiliates, service providers, authorized retailers, advertising and analytics partners, social-media platforms, publicly available sources, and people who refer you to us, as described above.

Business and Commercial Purposes for Collection. We collect each category for the business and commercial purposes described above, including providing the Services, personalization, marketing and advertising, analytics, product quality and adverse-event reporting, fraud prevention and security, legal compliance, and corporate transactions.

In the past 12 months, we have disclosed the categories of Personal Information we collect to service providers, contractors, affiliates, and other recipients described in this Privacy Policy for the business and commercial purposes described in this Privacy Policy.

In the past 12 months, we have sold or shared Categories A, D, F, G, and K to advertising partners, social-media platforms, and analytics providers for targeted advertising and cross-context behavioral advertising. We do not sell or share Categories B, C, E, H, I, J, or L, and we do not knowingly sell or share the Personal Information of any California resident under 16 years of age without the required opt-in consent.

California Privacy Rights

If you are a California resident, you may exercise the following rights, subject to verification and the exceptions provided under applicable law:

Right to Know. Request that we disclose the categories and specific pieces of Personal Information we have collected about you; the categories of sources of collection; the business or commercial purposes for collecting, selling, or sharing Personal Information; and the categories of third parties to whom we have disclosed, sold, or shared your Personal Information.
Right to Delete. Request that we delete Personal Information we have collected from you, subject to the exceptions permitted by law.
Right to Correct. Request that we correct inaccurate Personal Information we maintain about you.
Right to Opt-out of Sale or Sharing. Opt-out of the sale or sharing (for cross-context behavioral advertising) of your Personal Information.
Right to Limit Use and Disclosure of Sensitive Personal Information. KGC does not use Sensitive Personal Information for purposes other than those permitted under CCPA Regulations § 7027(m).
Right to Non-Discrimination. We will not discriminate against you for exercising your California privacy rights. Participation in financial-incentive programs, including the Rewards Program, is voluntary and governed by the Rewards Program terms and the Notice of Financial Incentive above.
Shine the Light. California Civil Code § 1798.83 entitles California residents to request information concerning whether KGC has disclosed Personal Information to third parties for the third parties’ own direct-marketing purposes. You may submit a Shine the Light request to support@kgcus.com with the subject line “Shine the Light Request.”

Global Privacy Control

KGC recognizes and honors the Global Privacy Control (GPC) and other browser-based opt-out preference signals where required by California law. When we receive a valid GPC signal from a browser or device, we treat it as a request to opt out of the sale or sharing of Personal Information associated with that browser or device. Because GPC signals are browser- or device-specific, we may not be able to link them to a specific identifiable individual absent additional information.

Other U.S. State Privacy Rights

If your state of residence has a comprehensive consumer privacy law that applies to us, you may have rights to confirm and access your Personal Information, correct inaccuracies, request deletion, opt out of targeted advertising and the sale of Personal Information, and appeal a denial of a rights request, subject to the exceptions and conditions in your state’s law. We will not discriminate against you for exercising these rights, and we honor opt-out preference signals (including GPC) where required by law. To exercise a right, use the request method below. If we deny your request and your state law provides an appeal right, you may appeal by replying to our decision email or contacting us using the methods below with the subject line “Privacy Appeal.”

Nevada residents may direct us not to sell certain personal information by emailing support@kgcus.com with the subject line “Nevada Privacy Request.” KGC does not currently sell Personal Information as defined under Nevada law.

How to Submit a Privacy Rights Request

You may submit a privacy rights request by email to support@kgcus.com or by mail to Korean Red Ginseng Corp, Inc., Attn: Privacy, 12750 Center Court Dr. S, Ste 100, Cerritos, CA 90703. California residents may also use the “Do Not Sell or Share My Personal Information” link in the website footer to opt out of sale or sharing.

Verification. We take reasonable steps to verify your identity before responding. If you have an account, we may ask you to authenticate; otherwise, we may ask for information that matches information we hold. For high-risk requests, we may require a signed declaration. We use verification information only to verify the request and will not be able to comply if we cannot verify your identity.

Authorized Agents. You may use an authorized agent. We accept a valid power of attorney or written, signed designation that includes information sufficient for us to verify the agent’s authority. We may also ask you to verify your identity with us directly and confirm the agent’s authority.

Timing. We will respond within the time required by law, generally within 45 calendar days from receipt, and may extend that period once where reasonably necessary, with notice. If we cannot comply in whole or in part, we will explain why.

Household Requests. For a household request, each member must submit and be individually verified. We may decline if we cannot verify each member.

Fees. Rights requests are generally free. We may charge a reasonable fee, or decline to act, on requests that are manifestly unfounded, excessive, or repetitive, as permitted by law.

Data Retention

We retain Personal Information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain your account, fulfill orders, administer subscriptions and the Rewards Program, comply with legal, tax, accounting, product-quality, recall, and regulatory obligations, resolve disputes, enforce agreements, and protect against fraud or misuse. The criteria we use to determine retention periods include the type and sensitivity of the information, the purpose for which it was collected, whether we have an ongoing relationship with you, applicable legal requirements, and the need to preserve records for dispute resolution, safety, security, or business-continuity purposes. When Personal Information is no longer needed, we delete, destroy, or deidentify it.

We maintain reasonable administrative, technical, and physical safeguards to protect Personal Information against unauthorized access, disclosure, alteration, or destruction. No system is completely secure, and we cannot guarantee absolute security.

The Services are intended for individuals in the United States. KGC operates the Services from the United States. If you access the Services from outside the United States, your Personal Information will be transferred to and processed in the United States, where our Services are operated.

We may update this Privacy Policy from time to time. The “Last Updated and Effective Date” shows when it was last revised. We may notify you by posting the updated policy on the Services, updating the Last Updated and Effective Date, and providing additional notice where required by law. We will notify you of material changes as required by law and, where required, obtain your consent. Your continued use of the Services after the effective date will be subject to the updated Privacy Policy to the extent permitted by law.
